WHEREAS, Eric D. Daugherty, by his certain Deed of Trust dated November 16, 2016 and recorded in the Recorder's Office of St. Francois County, Missouri, in Document No. 2016R-10378 conveyed to the Trustee, the following described property situate, lying and being in the County of St. Francois, State of Missouri, to-wit:

All of the SURFACE RIGHTS ONLY in and to that piece of ground: Beginning Eighty-five (85) feet North 71 degrees East of the Southeast corner of the J.W. Helber lot, running thence North 71 degrees East 50 feet; thence North 18 degrees 30' West One hundred Seventy four and one-half (174 1/2) feet; thence South 71 degrees West Fifty (50) feet to the Northeasterly corner of H.C. Lauth's Lot; thence South 18 degrees 30' East One hundred Seventy-four and one half (174 1/2) feet to the place of beginning.

All of the SURFACE RIGHTS ONLY in and to that part of Block numbered Eleven (11) of the Town of Bonne Terre, described as follows: Beginning at a point North 71 degrees East distant 135 feet from the Southeast corner of J.W. Helber's Lot (shown upon the recorded plat of said town as Lot 6, in Block 11), the said point of beginning being at the Southeast corner of a certain tract conveyed by the parties of the first part herein to X.F. Ney and wife by Deed recorded in Book 135 at page 214 in the Recorder's Office of St. Francois County, Missouri, running thence North 71 degrees East, along Benham Street, 15 feet to a point; thence North 18 degrees 30 minutes West 174.5 feet; thence South 71 degrees West 15 feet to the Northeast corner of the tract of land conveyed to X. F. Ney as aforesaid; thence South 18 degrees 30 minutes East 174.5 feet to the beginning.

Which said conveyance was made in trust to secure the payment of a certain promissory note described in the Deed of Trust and whereas by the terms of the Deed of Trust and Note, the note is past due and remains unpaid, therefore, in conformity with the provisions of the Deed of Trust and at the request of the legal holder of the note, the undersigned Trustee, will on THURSDAY

JANUARY 25, 2018

between the hours of nine o'clock in the forenoon and five o'clock in the afternoon of that day at 1:00 P.M. at the South Front door of the County Court House in the City of Farmington, in the County of St. Francois, State of Missouri, sell at public auction to the highest bidder, for cash, the above described real estate to satisfy the note and the cost of executing this trust.
