Madison County Commission Minutes
September 22, 2008
On September 22, 2008, The Honorable Madison County Commission met pursuant to adjournment on with the following officers present; Presiding Commissioner John Rauls, First District Commissioner Dennis Bradford, and Second District Commissioner Terry Hovis.  County Clerk Don Firebaugh was present to record the proceedings.

Mr. Bud Allen, Mr. Keith DeSpain, Ms. Karen Yates, Ms. Ruth Ann Skaggs, and Mr. Sheldon Combs attended the meeting.

Presiding Commissioner John Rauls called the meeting to order at 9:00 A.M.  The following business was transacted.

A motion was made by Commissioner Hovis to accept the agenda as presented and was seconded by Commissioner Bradford. Motion carried by vote: Presiding Commissioner Rauls (yes) and Commissioner Bradford (yes), and Commissioner Hovis (yes).

Minutes from the last meeting on September 15, 2008 were read by County Clerk Don Firebaugh.  A motion was made by Commissioner Hovis to accept the minutes as presented.  The motion was seconded Commissioner Bradford.  Motion carried by vote: Presiding Commissioner Rauls (yes) and Commissioner Bradford (yes), and Commissioner Hovis (yes).

E-911 Director Steven Perkins was at a training seminar and no report was available.

Road and Bridge Supervisor Gregg Pruett reported all work accomplished by his department the past week and the operational status of equipment.  He said one tandem dump truck is not operational and another new dump truck is being repaired under warranty for some small defects.  Pruett said the department plans to finish blacktopping on County Road 447 this week.  He also commended the residents in Madison County that received damages from the severe storm last weekend that helped the Road & Bridge "do its job."

First District Commissioner Dennis Bradford said he had been to Road & Bridge department and evaluated the condition of the heavy equipment.  He will meet with McCaul Engineering Company today on County Road 516 and look at the new bridge site that will commence as soon as the bids are received and approved. 

Second District Commissioner Terry Hovis said he received calls from residents on County Road 205 needing limbs taken down from the storm last weekend.

Commissioner Bradford made a motion to place a request in the Democrat News for a maintenance person that can work on the courthouse air conditioning, heating, and some other maintenance problems when needed.  Commissioner Hovis seconded the motion.  Motion carried by vote: Presiding Commissioner Rauls (yes) and Commissioner Bradford (yes), and Commissioner Hovis (yes). 

Commissioner Hovis made a motion to abate $ 35.22 for mineral rights back taxes presented by Charla Royer, Madison County Collector.  Commissioner Bradford seconded the motion.  Motion carried by vote: Presiding Commissioner Rauls (yes) and Commissioner Bradford (yes), and Commissioner Hovis (yes).  She said under current law, the mineral rights can be sold to the current landowner after three years of attempting to sell delinquent back taxes and no one purchases them at the yearly county auction.

Bills from the previous week were presented.  Commissioner Bradford made a motion to pay all bills and was seconded by Commissioner Hovis.  Motion carried by vote: Presiding Commissioner Rauls (Yes), Commissioner Bradford (Yes), and Commissioner Hovis (Yes).

Dennis Cox from Smith & Company Engineering appeared and requested the Commission's approval to commence bidding on a new bridge on County Road 537 over Brewer's Creek.  Commissioner Bradford made a motion to authorize Smith & Company to place ads in the local newspapers for two weeks.  Commissioner Hovis seconded the motion.  Motion carried by vote: Presiding Commissioner Rauls (yes) and Commissioner Bradford (yes), and Commissioner Hovis (yes).

McCaul Engineering Company appeared and requested permission to place ads in local newspapers for two weeks allowing contractors to bid on the new bridge on County Road 516.  Commissioner Bradford made a motion that will allow McCaul Engineering Company to place ads in local newspapers for two weeks providing contractors the opportunity to bid on the new bridge on County Road 516.  Commissioner Hovis seconded the motion.  Motion carried by vote: Presiding Commissioner Rauls (yes) and Commissioner Bradford (yes), and Commissioner Hovis (yes).

Sealed bids will be opened by the Madison County Commission on October 20, 2008, beginning at 10:00 A.M. for both bridges.

Commissioner Bradford made a motion to adjourn and was seconded by Commissioner Hovis.  Motion carried by vote: Presiding Commissioner Rauls (Yes), Commissioner Bradford (Yes), and Commissioner Hovis (Yes).

No further business was transacted on September 22, 2008.

Ordered that the Commission adjourn until 9:00 A.M. on September 30, 2008.
