Desloge files petition to condemn property
DESLOGE — Attorneys for the City filed a petition of condemnation Monday in court to proceed with eminent domain proceedings. The property in question is located at 6286 Spencer Road. The city is seeking the property for the Eastern Road Project. City Administrator Greg Camp said the city negotiated for all the other parcels of ground needed for the project.
“This is unfortunate that we couldn’t get something worked out on this final piece,” he said.
The parcel consists of about four acres and is tied up in three different trusts. Camp said the trusts involved include Sunflower, Sunrise and Zane.
He said the city’s attorneys expect a jurisdiction hearing will be scheduled for some time in May.
“After the filing of the petition, the hearing will be the next step,” Camp said.
The construction of the Eastern Outer Road will be east of U.S. 67 extending from Highway 8 south to the Parkway Interchange, including the bridge crossing Flat River.
In May 2006, the board of aldermen approved an intergovernmental agreement with the Missouri Highway and Transportation Commission that provided financing for the outer road.
The estimated cost for the project is $4,027,619, but through the agreement Desloge will only be responsible for $1.125 million. The remainder will be paid by the federal government and MoDOT.
