UPDATED: Charges filed against aunt in babysitting death

IRON COUNTY – The aunt of a young boy in her care has been charged with  first degree abuse of a child resulting in death and involuntary manslaughter.

Marcia Kelly, 30, of Viburnum was charged with the death of her nephew, Eric Kelly, 3, who died March 23 at Cardinal Glennon Hospital from a brain injury.

The charges were filed Friday following completion of an investigation by the Iron County Sheriff’s Office, along with several other state and local agencies.

An autopsy on the young boy found he died from a number of serious injuries that included bleeding inside the skull, bleeding within the eyes, two bruises on his forehead and a lesion on the inner portion of his upper lip. 

According to the probable cause statement, Kelly, who was baby-sitting her nephew, told police that on March 22 she had just finished feeding lunch to Eric and her son. After helping Eric down from his chair she started to reach for her son. At this point she claims to have heard Eric fall on the living room floor where she then found him unresponsive.

Hospital staff and the doctor who performed the autopsy on young Kelly said his injuries were not consistent with a short fall to the floor as described by the aunt.

Marcia Kelly is being held in the Iron County Jail.
