A man serving 13 years in the Farmington Correctional Center for the enticement of a child has new charges in St. Francois County.
Kyle Shawn Herrington, 38, of Ellsinore, was charged this week with one count of felony statutory rape, one count of felony statutory sodomy, one count of felony child molestation, and two counts of felony enticement of a child.
A probable cause statement from the St. Francois County Sheriff’s Department (SFCSD) says that on Nov. 20, 2023, police were assigned a case for an alleged sexual assault. A young girl (G1) allegedly messaged a friend via her school’s server, saying she was raped. The message was flagged, school staff was alerted, and a hotline call was made to the children’s division.
During an interview with children’s division investigators, G1 said she was raped by Herrington while in her bedroom when she was four or five years old in 2013. G1l allegedly mentioned the name of a possible second rape victim (G2). G2 was interviewed by children’s division investigators and said Herrington asked her to touch him and would “rub her thighs and try to do sexual stuff with her.”
In December, both girls were interviewed again and reiterated their previous statements. G1 stated that Herrington used his hands to touch her private area and raped her. G2 said that on two separate occasions when she was five, Herrington touched her thighs and asked her to touch him. G2 said she told Herrington no, so he chased her with his belt. She stated she locked herself in her bedroom to get away from him.
Herrington is currently incarcerated at the Farmington Correctional Center. A 13-year-old girl accused Herrington of sexual assault in 2016, and two years later, Herrington was convicted of felony enticement of a child during a jury trial in St. Francois County. Herrington appealed the case several times based on ineffective counsel. However, the court has denied all appeals.
