Bonne Terre man faces multiple felony charges

David Remshardt, 27, of Bonne Terre is facing four felony charges stemming from an incident that took place on Sep. 17 at a St. Francois County residence: burglary in the first degree, armed criminal action, unlawful use of a weapon, and assault in the fourth degree.
According to the St. Francois County Sheriff’s Department’s probable cause statement (PCS), a deputy was dispatched in reference to a disturbance reported at a St. Francois County resident. Confidential Witness 1 (CW1) and Confidential Witness 2 (CW2) told the deputy that they had been out making door Dash deliveries when they got a call from CW1’s 12-year-old son. The Confidential Victim (CV, the son of CW1) said the defendant, Remshardt, came to their home with a firearm and pointed it at each of the five people who were present; he made threats to shoot and kill all of them.
CV said that he heard knocking at the front door, and thought it was his mother (CW1) coming back home from Door Dash deliveries, and he opened the door. Remshardt pushed past CV held a handgun, and went into a room and pointed the firearm at each person. CV stated that the defendant told every that the gun was a loaded 9mm and that he “wasn’t afraid to use it.”
In the PCS, the deputy reported that when he made contact with Remshardt, he did find a loaded Hi-Point 9mm in the defendant’s front pocket and the magazine held five rounds of ammunition. While the deputy transported the defendant, Remshardt made a variety of threatening statements including “I’ll kill them all.”
On Sep. 18, Remshardt stood before Judge Robin Fulton for an initial appearance. He was notified of his rights and the charges against him. He applied for the services of a public defender.
Assistant Public Defender Holly Kee was assigned as counsel for the defense on Sep. 19.
A confined docket hearing and a counsel status hearing are scheduled before Judge Fulton on Sep. 26.
The defendant is being held at the St. Francois County Jail on a $200,000 cash or surety bond with special conditions: shall not possess a firearm, ammunition or dangerous weapons; no contact with the victims or the witnesses in this case; GPS monitoring device at his expense prior to release from custody and be subject to continuous such monitoring while on bond; submit to blood, breath or urinalysis testing upon request of the court, a law enforcement officer or bond supervisor at his expense; immediately provide all prescriptions for controlled substances to his bond supervisor; be subject to supervision by a pre-trial release supervision company and shall contact said agency prior to release, and shall pay all fees and obey all directives given by said agency or its officers; appear in court as required; submit to the orders, judgment and sentence and process of the court; not commit any new offenses; not tamper with any victim or witness in the case, nor have any person do so on defendant’s behalf; fully comply with all conditions of release imposed by the court; and, shall not possess or use alcoholic beverages or controlled substances unless lawfully prescribed.
