NOTICE OF TRUSTEE'S SALE

WHEREAS, Leonard W. Martin, also known as Leonard Martin, by his certain Deed of Trust dated October 22, 2014 and recorded in the Recorder's Office of St. Francois County, Missouri, as Document No. 2014R-08962 conveyed to the Trustee, the following described property situate, lying and being in the County of St. Francois, State of Missouri, to-wit:

Parcel 1: 400 S. Firmin St.

Tract 1: All of the SURFACE RIGHTS ONLY in and to part of the East Half of the Northwest Quarter of the Northeast Quarter of Section 13, Township 36 North, Range 4 East, described as follows , to wit: Begin at the Southeast Corner of Lot owned by Wm. Evans and run thence West 105 feet to Southwest corner of said Wm. Evans Lot; thence North 140 feet Northwest corner of Lot owned by H.A. Miller; thence West 105 feet to the Northeast corner of Lot owned by Frank Henson; thence South 350 feet to the Northwest corner of Lot owned by Joe T. Evans, thence East 105 feet to southwest corner of Lot owned by John Long; thence North 70 feet to Northwest corner of said John Long's Lot; thence East 95 feet to northeast corner of said John Long's Lot; thence North 140 feet to the place of beginning.

EXCEPT a strip of land heretofore conveyed to Cecil L. Graham and Hazel Graham to Lattie Goggin and Effie Goggin by deed dated May 11, 1935 and recorded in the Recorder's Office of St. Francois County, Missouri, in Book 185 at page 347.

EXCEPT all that part conveyed to the City of Elvins by Warranty Deed recorded in Book185 at page 518.

Evans described in a Warranty Deed recorded in Book 130 page 583 and run thence West 105 feet to Southwest corner of said Wm. Evans Lot; thence North 140 feet Northwest corner of Lot owned by H.A. Miller described in a Warranty Deed recorded in Book 121 page 507; thence West 105 feet to the Northeast corner of Lot owned by Frank Henson described in a Warranty Deed recorded in Book 130 page 252; thence South 350 feet to the Northwest corner of Lot owned by Joe T. Evans described in a Warranty Deed recorded in Book 59 at page 196, thence East 105 feet to Southwest corner of Lot owned by John Long described in a Warranty Deed recorded in Book 130 page 353; thence North 70 feet to Northwest corner of said John Long's Lot; thence East 95 feet to the Northeast corner of said John Long's Lot; thence North 140 feet to the place of beginning.

Evans and part of the S.E. corner of Lot formerly owned by I.W. Miller.

Tract 1: All of the SURFACE RIGHTS ONLY in and to a tract of land situated in the City of Bonne Terre, County of St. Francois and State of Missouri, lying in part of Lot 6, Block 3, Flower's and Fite's Subdivision of Lot 17, Bogytown, a subdivision filed for record in Plat Book 2 at page 7, described as follows, to wit: Commencing at the Southeast corner of said Lot 6, thence North 01 degrees 07 minutes 56 seconds East 56.00 feet along the East line of said Lot 6 to a set No. 5 rebar, the point of beginning of the tract herein described, thence leaving said East line, North 85 degrees 10 minutes 25 seconds West 145.93 feet to a set No. 5 rebar on the West line of said Lot 6; thence along said West line, North 00 degrees 18 minutes 30 seconds West 42.18 feet to a set No. 4 rebar marking the Northwest corner of Lot 6; thence leaving said West Line, along the North Line of said Lot 6, South 85 degrees 06 minutes 27 seconds East 147.01 feet to a set No. 4 rebar, marking the Northeast corner of said Lot 6, on said East line; thence leaving said North line, along said East line, South 01 degrees 07 minutes 56 seconds 41.93 feet to the point of beginning.

EXCEPT All right, title and interest in and to the underground and mineral rights as set forth in instruments recorded in Book 45 at page 425 and in Book 75 at page 320.

Tract 2: All of the SURFACE RIGHTS ONLY in and to all that part of Lot Six (6), Block Three (3), Flower's 7 Fite's Subdivision of Lot 17 of Bogytown, a subdivision filed for record in Plat Book 2 at page 7, described as follows to-wit: Commencing at the Southeast corner of said Lot 6, the point of beginning of the tract herein described, thence along the South line of said Lot 6, North 85 degrees 07 minutes 50 seconds West 144.53 feet to a set No. 4 rebar marking the Southwest corner of said Lot 6; thence leaving said South line along the West line of said Lot 6, North 00 degrees 18 minutes 30 seconds West 56.00 feet to a set No. 5 rebar, thence leaving said West line, South 85 degrees 10 minutes 25 seconds East 145.93 feet to a set No. 5 rebar on the East line of said Lot 6, thence along said East Line South 01 degrees 07 minutes 56 seconds West 56.00 feet to the point of beginning.

EXCEPT All right, title and interest in and to the underground and mineral rights as set forth in instruments recorded in Book 45 at page 425 and in book 75 at page 320.

Which said conveyance was made in trust to secure the payment of a certain promissory note described in the Deed of Trust and whereas by the terms of the Deed of Trust and Note, the note is past due and remains unpaid, therefore, in conformity with the provisions of the Deed of Trust and at the request of the legal holder of the note, the undersigned Successor Trustee, will on WEDNESDAY

August 7, 2019

between the hours of nine o'clock in the forenoon and five o'clock in the afternoon of that day at 1:00 P.M. at the North door (entrance from parking lot) of the St. Francois County Annex Building, 1 West Liberty Street, in the City of Farmington, in the County of St. Francois, State of Missouri, sell at public auction to the highest bidder, for cash, the above described real estate to satisfy the note and the cost of executing this trust.
