An area man is facing a felony charge after he allegedly raped a girl less than 12 years old while she was in his care.

Danny Marcee Jr, 34, of Villa Ridge, formerly of Bismarck, is being charged with felony rape in the first degree.

According to a probable cause statement, on July 20 a forensic interview took place at the Children’s Advocacy Center in Farmington with a girl, who said while she was in fourth grade Marcee sexually assaulted her.

The girl told the investigator that Marcee took her up to the attic in a home in Bismarck and raped her. She explained there was a ladder to the attic and Marcee carried her up there. The girl said Marcee held her down, put tape over her mouth and sexually assaulted her. She also said that when the tape fell off her mouth, Marcee put a rope in her mouth.The girl said he gave her $5 after the assault.

She also disclosed another incident that occurred while she was in fifth grade. She said Marcee made her go to the attic and he tied her hands to the floor and to a pole. Marcee then sexually assaulted her. She said this happened on more than one occasion.

Marcee is wanted on a warrant with a $150,000 bond. If released, he is to have no contact with the victim and have an GPS monitor installed.
